In a legal triumph for the protection of public finance, the Kuwaiti Criminal Court issued a landmark judgement providing for the life imprisonment of seven accused in the Investment Port Fund case, obliging them to repay large sums and fine them with their weakness, in one of the largest cases of the seizure of public funds in the history of the country.
This provision is the culmination of vigorous legal efforts by the Messenin Law Group, led by the partners, Professor Walid Taltan and Dr. Tariq Diab.
The team represented one of its agents, presenting an integrated complaint to the Public Prosecutor ' s Office, which included up to 30 incidents of gross assault on public money.
Over three years of stressful investigations, the Mason team provided unlimited technical and documentary support to the Public Prosecutor ' s Office, which contributed to the detection of a systematic pattern of photo contracts, illicit commissions and suspicious bank transfers aimed at draining the assets of the Fund.
The Court, headed by the Chancellor, was presided over by the following:
First: Corporal punishment: life imprisonment for the first to seventh accused.
II. Job segregation: separation of accused persons from 1 to 5 of their posts.
Financial sanctions were: the defendants were required to pay KWD 49,462,689 (40 million, 400,000, 600,809 dinars) and to fine them a total amount of KWD 98,925,378 (80 million, 95,000, 235,000, 300, 78).
Removal: deportation of foreign accused (second, fourth and fifth) from the country following the execution of the sentence.
In its judgement, the Court confirmed that these crimes were not merely administrative errors, but rather an integrated pattern of deliberate actions to drain the Fund ' s funds and to use them for private interests.
The Court explained that the Fund ' s funds were considered public funds in view of the contribution of the General Social Insurance Corporation and the KPC to its capital by more than 25%.
